Booking Terms & Conditions
Contract
The Contract for a short-term holiday rental shall be made between the Client and Ms J Smith. The Contract shall be governed by UK Law and confers upon the tenant the right to occupy only for holiday purposes within the meaning of Para 9, Schedule 1 of the Housing Act 1988. It will be entered into when the deposit is processed and Ms J Smith issues the confirmation letter. The Contract will be subject to all the following booking conditions.
Bookings
Bookings will only be accepted on the completion of a booking form and a deposit of 25% of the total amount payable in respect of the booking as shown on the booking form (excluding the Security Deposit), if a booking is made less than six weeks before the start of the holiday the full amount must be paid at the time of the booking (plus the Security Deposit).
Payment of Balance
a) The date on which the balance is payable will be sent out with the booking confirmation, but in any event, must be paid not later that six weeks before the stay is due to commence (‘the due date’)
b) The deposit will be accepted in part payment of the total payable is respect of the booking. If the balance of the total payable is not paid in full by the due date, the owner shall be entitled to cancel the booking without notice to the Client and without incurring any liability to the client in respect of any loss or damage following such cancellation. The cancellation will be deemed to have been made by the Client and the provisions of the cancellation clause shall apply in such case.
c) Payment can be accepted by cheque if it is denominated in sterling (UK pounds) or credit & debit cards (via Paypal). All payments shall be made to Ms J Smith at the address at the bottom of the Booking Form.
Cancellation
a) In the event of cancelation of the booking by the client the total payment in respect of the holiday (excluding the Security Deposit) will be non-refundable unless the owner is able to re-let the accommodation for the relevant period (or any part of it) the owner will refund the client a pro-rata amount.
b) Whist all bookings are accepted in good faith, in the extremely unlikely event of any occurrence making it unnecessary for the owner to cancel the booking, the owner ‘s liability shall be limited to the immediate return in full of all monies, paid by the client in respect of the booking.
c) Although cancellations cannot be unavoidable it is recommend that you take out a holiday insurance. Cancellations must be notified in writing.
VAT
No VAT is applicable.
Security Deposit
A Security Deposit is payable on the balance due date and this is will be cashed prior to the holiday and held by the owner to cover losses, damage and additional cleaning charges if the property is left in an unsatisfactory condition. The deposit, less and charges will normally be refunded within 7 days of the stay except in those cases where an estimate has to be obtained for the cost of repairs of replacement.
The Client is liable for the full amount of any damage and the Client’s liability is not limited to the amount of the Security Deposit.
Occupancy
Occupancy commences after 2.30pm (unless specifically stated otherwise or by prior arrangement) on the day of arrival and terminates at 10am on the day of departure. It is important that the property is vacated by the agreed time to ensure the cleaning is sufficient and available on time for the next guests. The number of persons occupying the property must not exceed the number agreed as per the booking form. Ms J Smith (or the appointed Property Manager) reserves the right to refuse entry to the entire party if this condition is not observed.
Complaints
Should there be any cause for complaint during the occupation of the property, it must be notified promptly to Ms J Smith (or the appointed Property Manager) and in the case of a serious problem confirmed in writing.
Care of the Property
The Client shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and in the same clean and tidy condition as on the day of arrival.
Pets
Pets are strictly not permitted in this property.
Linen
Bed linen is included the price, and the bed will be made up on arrival.
Children
Guests must accept responsibility for the safety of their children.
General
a) The inventory displayed in the property will be deemed to describe the contents of the property correctly unless discrepancies are reported to the Owner or Property Manager within 24 hours of arrival.
b) The client shall not cause or allow to be caused any nuisance of annoyance to any occupant of neighbouring premises and noise should be limited after 11pm. The owner/property manager reserves the right to terminate the tenancy immediately if any of the above conditions are not observed.
c) Ms J Smith (or the appointed Property Manager) do not accept third party liability in respect of breach of contract, negligence, misrepresentation or otherwise.
d) Ms J Smith (or the appointed Property Manager) shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.
e) The client is authorised to sign the booking form either by print and return/with an electronic signature or on arrival at the property.
